GENERAL TERMS AND CONDITIONS FOR WEBSITE/MOBILE APP INCLUDING ONLINE PAYMENTS

Introduction:
These terms and conditions apply to the User who uses thisWebsite/Mobile App for accessing information and/or payment to be made to COUNCIL FOR FAIR BUSINESS PRACTICES (“CFBP”). The Terms and Conditions of using this Website/Mobile App by the User / registered members of the Website/Mobile App (“You”) describes the terms on which CFBP offers you the services. Before using this Website/Mobile App, you must carefully read, understand, accept and agree to abide by all the terms and conditions under this Agreement. If you do not agree to these terms and conditions under the Agreement, please do not use the Website/Mobile App.

CFBP reserves the right to revise, amend or modify the policy entailed in this disclaimer at any time and in any manner as it may deem fit. Any change or revision so effected will be posted on the site. It is therefore important that you review these terms regularly to ensure you are updated as to any changes.

By authorizing a payment to CFBP through the online payment service ("the Payment Service"), the Applicant would be deemed to have accepted the terms and conditions of the Payment Service. CFBP reserves all the rights to amend these terms and conditions at any time without giving prior notice. It is the responsibility of the Applicant to have read the terms and conditions before using the Payment Service.

Key terms:
The following are the key terms of the Website/Mobile App:

  1. CFBP owns the intellectual property rights to every single piece of information that is accessible to the USER/Applicant.
  2. CFBP aspires to be a dynamic Website/Mobile App by adding new features and content regularly for the benefit of visitors. For this purpose, the Website/Mobile App may be temporarily shut down for updation work. However, CFBP will put its best efforts to minimize the inconvenience caused due to non-availability of Website/Mobile App.
  3. At CFBP, we make every effort is made to keep the Website/Mobile App up and running smoothly. However, CFBP takes no responsibility for, and will not be liable for, the Website/Mobile App being temporarily unavailable due to issues beyond our control.

The following are the key terms of the Payment Service:

  1. Payment(s) through the Payment Service may only be made with a Credit Card, Debit card or Net Banking by the individual or legal entity wishing to become a member (the “Applicant”).
  2. Before using the Payment Service, it is recommended that the Applicant shall make necessary enquiry about the charges or fees payable against the Credit/Debit card used from Credit Card or the Debit Card service provider i.e. the respectiveBank.
  3. The credit card information supplied at the time of using the service is processed by the payment gateway of the service provider and is not supplied to CFBP. It is the sole responsibility of the User of the service to ensure that the information entered in the relevant fields are correct. It is recommended that you take and retain a copy of the transaction for record keeping purposes,which might assistin resolution of any disputes that may arise out or usage of theservice
  4. The Applicant agrees, understands and confirms that his/ her personal data including without limitation details relating to debit card/ credit card/net banking transmitted overthe Internet may be susceptible to misuse, hacking, theft and/ or fraud and that CFBP or the Payment Service Provider(s) have no control over suchmatters.
  5. The service is provided using a payment gateway service provider through a secure Website/Mobile App.
  6. However, neither the payment gateway service provider nor the CFBP gives any assurance, that the information so provided online by a user is secured or may be read or intercepted by a third party. CFBP does not accept or assume any liability in the event of such unauthorized interception, hacking or other unauthorized access to information provided by a user of theservice.
  7. CFBP and/or the Payment Service Providers shall not be liable for any inaccuracy, error or delay in, or omission of (a) any data, information or message, or (b) the transmission or delivery of any such data, information or message; or (c) any loss or damage arising from or occasioned by any such inaccuracy, error, delay or omission, non-performance or interruption in any such data, information or message. Under no circumstances shall the CFBP and/or the Payment Service Providers, its employees, directors, and its third party agents involved in processing, delivering or managing the Services, be liable for any direct, indirect, incidental, special or consequential damages, or any damages whatsoever, including punitive or exemplary arising out of or in any way connected with the provision of or any inadequacy or deficiency in the provision of the services or resulting from unauthorized access or alteration of transmissions of data or arising from suspension or termination of thePayment Service.
  8. The Applicant agrees that CFBP or any of its employees will not be held liable by the Applicant for any loss or damages arising from your use of, or reliance upontheinformation contained on the Website/Mobile App, or any failure to comply with these Terms and Conditions where such failure is due to circumstance beyond CFBP’s reasonable control.
No warranty: No warranty, representation or guarantee, express or implied, is given by CFBP in respect of the operation of the Payment Service.

Disclaimer and Limitation of liability: CFBP does not accept liability for any damage, loss, cost (including legal costs), expenses, indirect losses or consequential damage of any kind which may be suffered or incurred by the Applicant from the use of the Payment Service.

Governing law: These terms and conditions are governed by the laws of India and the competent courts at Mumbai shall have exclusive jurisdiction.

Dispute Resolution: Any dispute arising in relation to the terms and conditions will be submitted to a sole arbitrator appointed by CFBP under the provisions of the Arbitration and Conciliation Act, 1996 (as amended and re-enacted from time to time) and rules framed there under. The venue of Arbitration shall be at Mumbai.

Refund/Cancellation Policy: Fees once paid will not be refunded under any circumstances.
